Divorce FAQs

Helping individuals reach the best resolutions in the most difficult of situations.

What is a no-fault divorce?

It used to be that a couple could only get a divorce if one party did something that was grounds to end the marriage, like commit adultery. More recently a law was passed which allowed divorce even if no one is at fault but one party wants to end the marriage. This is a no-fault divorce.

What is an uncontested divorce?

When there are no disagreements over any financial or divorce-related issues.

How long does it take to get divorced?

That depends on how you choose to get divorced. It could take just a few months if you use a collaborative approach or it could take years if you go to litigation.

What is alimony?

The amount of money agreed upon that one spouse pays the other after a divorce to continue to support him/her.

Do I have to go to court to get divorced?

It depends on how you’re getting divorced. In an uncontested divorce, you may not need to appear in court at all. In New Jersey, in some counties, a brief uncontested divorce hearing is scheduled to “put through” your divorce. It is a very brief and simple administrative proceeding.

How much does it cost to get a divorce?

That completely depends on how you choose to get divorced. Mediation will probably be the most cost-effective way to get divorced as it only requires one specialist and only takes as many sessions as are necessary to resolve your disputes. But it is important to choose the method that’s right for you.
